1. Age Requirements & Eligibility

1.1 Minimum Age

To use CritForge, you must be:

  • 18 years or older, OR
  • 13-17 years old with verifiable parental or legal guardian consent

Users under 13 years of age are not permitted to use this service under any circumstances, in compliance with the Children's Online Privacy Protection Act (COPPA).

1.2 Parental Consent (Ages 13-17)

If you are between 13 and 17 years old:

  • You must have your parent or legal guardian read and agree to these Terms
  • By checking the parental consent box during signup, your parent/guardian confirms they:
    • Have read and agree to these Terms of Service
    • Understand the nature of AI-generated RPG content
    • Accept responsibility for monitoring your use of the service
    • Consent to the collection and processing of data as described in our Privacy Policy

1.3 AI Provider Requirements

CritForge uses AI services from Anthropic (Claude) and OpenAI (ChatGPT). By using CritForge, you also agree to comply with:

2. Prohibited Content & Use

2.1 Strictly Prohibited Content

The following content is absolutely prohibited and will result in immediate account termination:

  • Child Sexual Abuse Material (CSAM): Any sexual content involving minors (real, fictional, or AI-generated)
  • Self-Harm & Suicide: Instructions or encouragement of self-harm, suicide, or eating disorders
  • Hate Speech: Slurs, dehumanizing language, or content promoting discrimination based on race, religion, gender, sexual orientation, disability, or other protected characteristics
  • Real-World Violence: Instructions for making weapons, bombs, or planning real-world attacks
  • Dangerous Activities: Drug manufacturing instructions, hacking tutorials, fraud schemes, or other illegal activities

2.2 Off-Domain Content (Not Allowed)

CritForge is designed exclusively for D&D 5e and tabletop RPG content. The following requests are blocked:

  • Essays, articles, blog posts, or academic papers
  • Code, programming scripts, or software development
  • Poetry or non-RPG creative writing
  • Real-world advice (career, medical, legal, financial)
  • Homework or academic assistance
  • Generic tutorials or how-to guides (unrelated to D&D/RPGs)

2.3 Fantasy Violence (Allowed)

CritForge is designed for fantasy RPG content, which naturally includes combat and conflict appropriate for tabletop gaming:

  • ✓ Allowed: "The orc chieftain attacks with a greataxe" (fantasy combat)
  • ✓ Allowed: "The villain plots to conquer the kingdom" (fantasy conflict)
  • ✓ Allowed: "The dragon breathes fire at the party" (fantasy danger)
  • ✗ Prohibited: "Instructions for building a real weapon" (real-world violence)
  • ✗ Prohibited: "Planning an attack on a real location" (real-world violence)

3. Safety & Content Monitoring

3.1 Automated Safety Systems

All content generated through CritForge is subject to automated safety screening:

  • Input Screening: Your requests are analyzed before generation
  • Pattern Matching: Harmful patterns are detected using regex and normalization
  • External Moderation: OpenAI Moderation API provides ML-based content analysis
  • Output Classification: AI-generated content is reviewed for policy compliance
  • Drift Detection: Chat conversations are monitored to prevent topic manipulation

3.2 Violation Logging

All violation attempts are logged with the following information:

  • User ID and timestamp
  • Violation type and severity
  • SHA256 hash of input (actual harmful content is never stored)
  • Matched pattern or category

Violation logs are retained for safety monitoring and cannot be viewed by users to prevent reverse-engineering of safety systems.

3.3 Enforcement & Consequences

Critical violations (CSAM attempts, credible violence threats) result in immediate permanent ban regardless of history.

4. Service Description & Limitations

4.1 What CritForge Provides

CritForge is an AI-assisted content generation tool for Dungeons & Dragons 5th Edition and compatible tabletop RPGs. We provide:

  • NPC generation with stat blocks, personalities, and plot hooks
  • Plot and adventure generation (coming soon)
  • Map and location descriptions (coming soon)
  • Encounter building (coming soon)

4.2 SRD 5.2 Compliance

All generated content complies with the D&D 5th Edition System Reference Document (SRD 5.2):

  • No trademarked Wizards of the Coast content (e.g., "Mind Flayer", "Beholder")
  • No proprietary setting references (e.g., Forgotten Realms, Waterdeep)
  • Generic fantasy terms and SRD-compliant monsters only

4.3 AI Limitations & Disclaimer

⚠️ Important AI Limitations:

  • AI-generated content may contain errors, inconsistencies, or unbalanced mechanics
  • Game Masters should review and adjust content as needed for their campaigns
  • CritForge does not guarantee mechanical balance or rules compliance
  • AI outputs are suggestions, not official D&D content

5. Account & Data Management

5.1 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

5.2 Data Collection & Privacy

We collect and process data as described in our Privacy Policy: Privacy Policy:

  • Account information (email, display name)
  • Generation parameters and content metadata
  • Usage statistics (generations used, tokens consumed)
  • Safety violation logs (hashed, never storing actual harmful content)

5.3 Account Termination

You may terminate your account at any time by contacting support. Upon termination:

  • Your generated content will be deleted within 30 days
  • Safety violation logs will be retained for compliance purposes
  • Subscription refunds are handled according to our refund policy

6. Subscription & Payment Terms

6.1 14-Day Free Trial

  • 20 generations during trial period
  • Full Pro-level access to all features
  • All content types unlocked
  • No credit card required
  • Automatically reverts to Free tier after 14 days unless upgraded

6.2 Free Tier (Post-Trial)

  • 10 generations per month
  • NPC generation only
  • 1 campaign maximum
  • Standard PDF export
  • Subject to change with notice

6.3 Solo Tier ($15/month or $150/year)

  • 200 generations per month
  • Core content types: NPCs, plots (short/medium), encounters, treasure, monsters
  • Up to 3 campaigns
  • Standard PDF export
  • Go annual and get 2 months free

6.4 Pro Tier ($25/month or $250/year)

  • 500 generations per month
  • All content types including maps, factions, taverns, and long/marathon plots
  • Unlimited campaigns
  • Premium PDF export + VTT export
  • Session prep tools
  • Priority support
  • Go annual and get 2 months free

6.5 Billing & Refunds

Payments are processed via Stripe. Refund policy:

  • Full refund within 14 days of initial paid subscription
  • No refunds for subsequent billing cycles (cancel anytime, effective next cycle)
  • Annual subscriptions: Pro-rated refunds within first 30 days only, calculated as the annual price minus the monthly rate for each month used
  • Violations may forfeit refund eligibility

6.6 Automatic Renewal Disclosure

AUTOMATIC RENEWAL NOTICE: YOUR PAID SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD UNLESS YOU CANCEL BEFORE THE RENEWAL DATE.

By subscribing to a paid plan (Solo or Pro), you acknowledge and agree that:

  • Your subscription will automatically renew at the then-current price for the same billing period (monthly or annual) unless you cancel before the renewal date
  • Monthly subscriptions renew each month on the date of your initial subscription. Annual subscriptions renew once per year on the date of your initial subscription
  • You will be charged the applicable subscription fee (Solo: $15/month or $150/year; Pro: $25/month or $250/year) using the payment method on file with Stripe
  • CritForge will send you a reminder email at least seven (7) days before each annual renewal. Monthly subscribers will receive renewal confirmation after each charge
  • Prices may change with at least thirty (30) days' advance notice. If you do not cancel before a price increase takes effect, you will be charged the new price at your next renewal

How to Cancel

You may cancel your subscription at any time through your CritForge account settings or by contacting [email protected]. Cancellation takes effect at the end of your current billing period — you retain full access until then. No partial-period refunds are issued for cancellation mid-cycle.

7. User-Uploaded Content & Campaign Sharing

7.1 Content Sharing Scope

CritForge allows users to upload and share content such as maps, images, NPCs, encounters, and other campaign materials:

  • Content you create or upload is private to your account by default
  • You may share content with campaign members you invite — shared content is only visible to active campaign members
  • When a member leaves or is removed from a campaign, their access to your shared content is revoked
  • CritForge does not make your content public, use it for other users, or display it outside your campaigns
  • CritForge does not review, endorse, or assume responsibility for accuracy, quality, or compliance of uploaded content

7.2 Your Responsibility for Uploaded Content

By uploading content to CritForge, you represent and warrant that:

  • You own or have the legal right to use all uploaded content, or it is in the public domain or under a permissive license (e.g., Creative Commons)
  • Uploaded content does not infringe any third-party copyrights, trademarks, or other intellectual property rights
  • Uploaded content does not violate these Terms of Service or applicable laws
  • You grant CritForge a non-exclusive, worldwide license to store, display, and transmit your uploaded content within your account and to campaign members you have invited, for the purpose of operating the Service

7.3 AI Training

CritForge does not use user-uploaded content for AI model training, fine-tuning, or any machine learning purposes. Uploaded content is stored solely for your personal use within the platform.

7.4 CritForge's Rights

CritForge reserves the right to remove any uploaded content that:

  • Violates these Terms of Service or applicable law
  • Infringes third-party intellectual property rights
  • Contains prohibited content (see Section 2)
  • Is used in violation of platform policies
  • Threatens platform integrity or security

We will notify you of removal and provide the reason whenever possible, except in cases of critical policy violations.

8. Intellectual Property & Content Ownership

8.1 Your Generated Content

You own the content generated through CritForge, subject to these conditions:

  • You may use generated content in your personal or commercial D&D campaigns
  • You may modify, adapt, and distribute generated content
  • You acknowledge that similar content may be generated for other users
  • AI-generated content may include SRD 5.2 elements (which are open game content)

8.2 CritForge Platform

The CritForge platform, code, and safety systems remain our intellectual property. You may not:

  • Reverse engineer safety systems or pattern detection
  • Scrape or automate the service
  • Create derivative services using our prompts or systems

9. Disclaimers & Limitation of Liability

SERVICE PROVIDED "AS IS"

CritForge is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted or error-free service
  • Accuracy or quality of AI-generated content
  • Mechanical balance of stat blocks or encounters
  • Compatibility with specific game systems or house rules

LIMITATION OF LIABILITY

To the maximum extent permitted by law, CritForge shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or goodwill
  • Account suspension or termination
  • Third-party actions based on your use of generated content

Our total liability shall not exceed the amount you paid for the service in the past 12 months.

9.3 Indenização

9.4 Força Maior

Nenhuma das partes será responsável por qualquer falha ou atraso no cumprimento de suas obrigações sob estes Termos quando tal falha ou atraso resultar de causas além do controle razoável, incluindo, mas não se limitando a:

  • Desastres naturais, caso fortuito, enchentes, terremotos ou eventos climáticos severos
  • Guerra, terrorismo, distúrbios civis ou sanções governamentais
  • Pandemia, epidemia ou emergência de saúde pública
  • Interrupções de serviços de terceiros (incluindo provedores de IA como Anthropic ou OpenAI, hospedagem em nuvem, processadores de pagamento ou provedores de serviços de internet)
  • Falhas de energia, interrupções de internet ou falhas de telecomunicações
  • Ações governamentais, regulamentos ou ordens que impeçam o cumprimento

A parte afetada envidará esforços razoáveis para retomar o cumprimento assim que possível após o término do evento de força maior, e notificará prontamente a outra parte sobre a natureza e duração esperada do evento.

  • Prompt to re-accept updated terms on next login

Continued use of CritForge after notification constitutes acceptance of updated Terms.

11. Governing Law & Dispute Resolution

11.1 Governing Law

These Terms of Service and any dispute arising out of or related to them or the use of CritForge shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved through the following process:

  • Good faith negotiation between the parties for a minimum of thirty (30) days (required first step)
  • If negotiation fails, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in the State of Texas
  • The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction
  • For claims under the applicable small claims court jurisdictional limit, either party may elect to proceed in small claims court in the State of Texas instead of arbitration

11.3 Class Action Waiver

YOU AND CRITFORGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Unless both you and CritForge agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding.

You may opt out of this class action waiver by sending written notice to [email protected] within thirty (30) days of first accepting these Terms. Your notice must include your name, email address associated with your CritForge account, and a clear statement that you wish to opt out of the class action waiver.

11.4 General Provisions

  • If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect (Severability)
  • These Terms constitute the entire agreement between you and CritForge regarding the use of the service, superseding any prior agreements (Entire Agreement)
  • CritForge's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision (No Waiver)
  • CritForge may assign or transfer these Terms without restriction. You may not assign or transfer your rights under these Terms without CritForge's prior written consent (Assignment)

12. DMCA & Copyright Policy

12.1 Respect for Intellectual Property

CritForge respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA) of 1998. We have designated a DMCA agent to receive copyright infringement notifications.

12.2 DMCA Safe Harbor

CritForge qualifies for DMCA Safe Harbor protection under 17 U.S.C. § 512. As such, we:

  • Do not actively monitor user-uploaded content for copyright infringement
  • Respond promptly to valid DMCA takedown notices
  • Implement a repeat infringer termination policy
  • Accommodate standard technical protection measures

12.3 Filing a DMCA Takedown Notice

To file a copyright infringement notice, send written notification to our designated DMCA agent containing:

  1. Identification of the copyrighted work claimed to be infringed (with sufficient detail to locate it)
  2. Identification of the infringing material with sufficient detail to locate it on the platform
  3. Your name, address, telephone number, and email address
  4. A statement that you have a good faith belief that the material is not authorized
  5. A statement, made under penalty of perjury, that the information provided is accurate and you are authorized to enforce the copyright
  6. Your physical or electronic signature

12.4 Counter-Notification Process

If your content was removed due to a DMCA notice and you believe the removal was in error, you may file a counter-notification. Your counter-notification must include:

  1. Identification of the removed material and its former location
  2. A statement made under penalty of perjury that you have a good faith belief the removal was in error
  3. Your name, address, telephone number, and email address
  4. A statement that you consent to jurisdiction of the federal court in the district where you reside
  5. Your physical or electronic signature

After receiving a valid counter-notification, we will provide a copy to the original complaining party and restore the content within 10-14 business days unless they notify us of legal action.

12.5 Repeat Infringer Policy

CritForge has adopted a policy of terminating accounts of users who are found to be repeat infringers of copyright laws. Users who receive multiple valid DMCA takedown notices may have their accounts suspended or permanently terminated at CritForge's sole discretion.

Pursuant to 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorney's fees. CritForge takes false DMCA claims seriously and will pursue remedies available under law.

Agreement to Terms

By creating an account and using CritForge, you confirm that:

  • You are 18+ OR 13-17 with parental consent
  • You have read and agree to these Terms of Service
  • You will comply with the prohibited content policies
  • You understand that violations may result in account suspension or termination
  • You agree to comply with upstream AI provider terms (Anthropic, OpenAI)
  • You acknowledge the DMCA copyright policy and your responsibility for uploaded content
