CritForge Copyright Protection Policy
CritForge is committed to protecting the intellectual property rights of content creators and respects the copyrights of others. This policy outlines our procedures for addressing copyright infringement on our platform and how we comply with the Digital Millennium Copyright Act (DMCA) of 1998.
CritForge has designated a DMCA agent to receive and respond to copyright infringement notifications. We maintain a repeat infringer policy and work to balance the rights of copyright holders with the fair use rights of our users.
1. DMCA Compliance & Safe Harbor
CritForge qualifies for protection under 17 U.S.C. § 512 (Safe Harbor provisions) of the Digital Millennium Copyright Act. This means:
- We are not liable for copyright infringement committed by our users, provided we comply with DMCA requirements
- We have designated a DMCA agent to receive takedown notices
- We respond promptly to valid copyright infringement claims
- We maintain a policy of terminating repeat infringers
- We accommodate standard technical protection measures for copyrighted works
2. What Constitutes Copyright Infringement
Copyright infringement on CritForge generally occurs when a user:
- Uploads content they do not own or have permission to use
- Uploads entire copyrighted works or substantial portions without authorization
- Uploads content owned by someone else without attribution or permission
- Uploads content that directly violates another's exclusive rights (reproduction, distribution, display, performance)
Note: Fair use is a legal exception to copyright. Not all unauthorized uses are infringement. Fair use considerations include the nature of the work, the amount used, and the effect on the copyright holder's market. Questions about fair use should be directed to legal counsel.
3. Filing a DMCA Takedown Notice
If you believe your copyrighted work has been infringed on CritForge, you may submit a written DMCA takedown notice to our designated agent.
Required Elements (17 U.S.C. § 512(c)(3))
Your takedown notice must include all of the following:
- Identification of the Copyrighted Work
A description of the copyrighted work you claim has been infringed. If your notice covers multiple works, provide a representative list. Include the title, author, date of creation, and registration number (if registered with the U.S. Copyright Office).
- Location of Infringing Material
Specific information about where the infringing material is located on CritForge. Include direct URLs, page references, or other sufficient detail to allow us to locate and identify the content.
- Your Contact Information
Your full name, mailing address, telephone number, and email address. This allows us to contact you if we need clarification.
- Good Faith Statement
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy Declaration
A statement, made under penalty of perjury under the laws of the United States, that the information in your notice is accurate and that you are authorized to enforce the copyright owner's rights. (This has legal consequences for false claims.)
- Physical or Electronic Signature
Your physical signature or a valid electronic signature (such as a typed name in the signature line of an email).

4. Our Response to Takedown Notices
Upon receiving a valid DMCA takedown notice, CritForge will:
- Review the notice for compliance with statutory requirements
- If valid, promptly remove or disable access to the allegedly infringing content (typically within 24 hours)
- Notify the user who uploaded the content about the removal and provide them with a copy of the notice
- Preserve evidence of the removal for legal proceedings if necessary
While we aim to respond as quickly as possible, our response time may vary. In urgent cases, we may remove content pending review of the notice's validity.
5. Counter-Notification Process
If your content was removed due to a DMCA takedown notice and you believe the removal was a mistake, you have the right to submit a counter-notification under 17 U.S.C. § 512(g).
Required Elements
Your counter-notification must include:
- Identification of Removed Content
Identify the material that was removed and describe its previous location on CritForge, including URLs or other specific reference information.
- Statement of Good Faith Belief
A statement, made under penalty of perjury, that you have a good faith belief that the removal was in error due to a mistake or misidentification of the content.
- Your Identity Information
Your full name, mailing address, telephone number, and email address.
- Jurisdiction Consent & Service of Process
A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the party who filed the original takedown notice. Both elements are required by 17 U.S.C. § 512(g)(3)(D).
- Your Signature
Your physical or electronic signature.
Our Response
Upon receiving a valid counter-notification, CritForge will:
- Provide a copy of your counter-notification to the party who filed the original takedown notice
- Notify you that we will restore the content within 10-14 business days
- Wait 10-14 business days for the original complaining party to indicate they have filed a lawsuit before restoring the content
- Restore your content unless the complaining party provides evidence of legal action
Note: Submitting a false counter-notification may subject you to legal liability under 17 U.S.C. § 512(f).
6. Repeat Infringer Policy
CritForge maintains a policy of terminating the accounts of users who are found to be repeat infringers of copyright law. Specifically:
- Users who receive multiple valid DMCA takedown notices may have their accounts suspended or permanently terminated
- The determination of what constitutes a "repeat infringement" is made at CritForge's sole discretion
- We consider factors including the number of takedown notices, the severity of infringement, and the user's response to notices
- Termination may occur with or without prior warning, depending on the circumstances
Consequences of Termination
Upon account termination for repeat infringement:
- All content associated with your account will be removed
- You will no longer be able to use CritForge services
- Any active subscription will be forfeited without refund
- You may be prohibited from creating a new account
7. Technical Protection Measures
CritForge does not protect or support circumvention of technical protection measures (such as digital rights management or DRM) used to protect copyrighted works. Users agree not to circumvent, disable, or interfere with technical protection measures on CritForge or on content accessed through CritForge.
8. No Active Monitoring
CritForge does not proactively monitor user-uploaded content for copyright infringement. We rely on copyright owners to report infringement through our DMCA takedown process. This does not limit our ability to:
- Remove or disable access to content that appears to be clearly infringing
- Take action based on red flags or suspicious activity
- Cooperate with law enforcement and legal investigations
9. No Warranty
While CritForge strives to respond appropriately to DMCA notices, we make no warranty that:
- Content will be removed immediately or within any specific timeframe
- Our removal decisions will be error-free
- We will always correctly identify infringing content
- We will take action on informal complaints or notices that do not comply with DMCA requirements
Disputes over copyright ownership, licensing rights, fair use, and other complex copyright issues may require legal counsel to resolve.
10. False Claims & Perjury
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be liable to CritForge and the affected user for damages, including costs and attorney's fees. This means:
- Filing a false DMCA takedown notice is a crime punishable by actual damages, lost profits, and attorney's fees
- CritForge may pursue legal action against parties who file false DMCA claims
- Users harmed by false takedown notices may also have legal remedies against the complaining party
Only file a takedown notice if you have a genuine, good faith belief that infringement has occurred.
11. Use of Content for AI Training
CritForge does not use user-uploaded content or content generated on our platform to train, fine-tune, or improve our AI models. This applies to:
- Copyrighted content you upload to CritForge
- Content generated by our AI that may contain copyrighted elements
- Any derivative works created from uploaded content
However, our AI models are trained on publicly available data and SRD 5.2 content, which may include copyrighted works used under fair use. Generated content may inadvertently contain similarities to copyrighted works.
